Terms & Conditions
1. Introduction
These Terms and Conditions govern the commercial and operational relationship between PROFF-IT Investment Group (Pty) Ltd ("PROFF-IT", "the Company", "we", "us"), our enterprise clients, and subscribers to our agentic computing ecosystems, including VukaOS.
2. Infrastructure & Role of PROFF-IT
PROFF-IT operates as a corporate technology deployment group. We architect, manage, and license proprietary software frameworks, and coordinate vetted independent specialists to execute technical, creative, strategic, and advisory milestones for our clients.
3. Execution Frameworks
While PROFF-IT maintains absolute oversight of our technology environments and client delivery interfaces, specific specialized tasks within localized development tracks may be executed by vetted network engineering partners. Partners are bound to strict service level metrics to protect customer deliverables.
4. Limitation of Liability
PROFF-IT acts in good faith to maintain maximum system uptime and secure exceptional development talent. To the maximum extent permitted by the South African Consumer Protection Act (CPA), PROFF-IT shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising from temporary system latencies, third-party LLM API downtime, or localized delays within custom development tracks.
5. Project Continuation Guarantee
In the event that an independent network engineering partner fails to meet operational development standards, PROFF-IT reserves the right to instantly re-assign the technical parameters and code directories to another engineering node within our vetted infrastructure to guarantee seamless project velocity.
6. Intellectual Property (IP) & Asset Ownership
All proprietary algorithms, database architectures, and source code underpinning VukaOS remain the exclusive global property of PROFF-IT. Custom-coded assets, custom configurations, and strategic outputs generated explicitly for a client become the exclusive property of the client immediately upon receipt of final milestone payments.
7. Non-Solicitation Boundary
Corporate clients and ecosystem partners are strictly prohibited from soliciting, hiring, or engaging in direct-profit relationships with any internal engineer or platform partner introduced through the PROFF-IT infrastructure for a minimum duration of twenty-four (24) months post-engagement.
Privacy Policy (POPIA)
1. Scope & POPIA Compliance
In strict compliance with the South African Protection of Personal Information Act (POPIA), No. 4 of 2013, PROFF-IT implements rigid operational barriers to protect business infrastructure records, custom datasets, and personal identification records.
2. Data Collection Parameters
We collect corporate contact profiles, structured project briefs, operational telemetry, and custom context dataset strings provided during your workspace configuration. Financial parameters and credit card entries are processed directly through PCI-DSS compliant payment gateways (e.g., PayFast or Yoco) and are never stored on PROFF-IT servers.
3. Data Isolation & IP Integrity
Your data is your competitive advantage. PROFF-IT guarantees that your custom designs, prompt configurations, application logic, and uploaded proprietary data will never be sold, leased, shared, or repurposed. Every line of custom code and every data brief remains secure under strict end-to-end operational confidentiality.
Vulnerability Disclosure Policy
PROFF-IT Investment Group is committed to maintaining the absolute integrity of our sovereign computing infrastructure and customer workspace control rooms.
If you are an authorized security researcher and discover a potential vulnerability within our core engine or platform networks, we appreciate your assistance in disclosing it to us in a responsible manner.

We ask that you allow a reasonable window for our engineering team to remediate and patch the vulnerability before any public disclosure, and that you do not access, alter, or expose data belonging to any customer workspace node. We investigate all legitimate technical reports promptly.
Refund & Satisfaction Policy
1. The 48-Hour Satisfaction Guarantee
PROFF-IT stands firmly behind the architectural capability of VukaOS. If you launch a VukaOS workspace control room and find that the agentic workforce environment does not align with your current operational workflow demands, PROFF-IT offers a 100% money-back guarantee within forty-eight (48) hours of the initial digital purchase.
2. Statutory Exclusions & Fair Use Boundaries
To protect the proprietary strategic intelligence of the VukaOS platform from commercial exploitation, refunds will be voided instantly if any of the following parameters are detected within the initial 48-hour activation window:
- Data Scraped/Extracted: If a workspace utilizes active specialist agents to batch-generate and download more than three (3) high-value structured project files, competitive briefs, or financial models before requesting a refund.
- Account Sharing: If an active workspace seat profile shows parallel authentication coordinates from unauthorized external networks.
3. Transaction Fee Reclaim
In alignment with standard South African payment clearing protocols, refunds will be processed back to the original bank card utilized during check-out. Please note that while PROFF-IT returns 100% of our license fee, third-party transaction fees charged by localized clearing networks (e.g., PayFast merchant charges) may be non-refundable depending on the gateway's active institutional policies.
4. Cancellation After the Guarantee Window
Subscriptions cancelled after the initial 48-hour window will remain active until the end of the current paid monthly billing cycle. No pro-rata refunds will be issued for partial month cycles following the closure of the guarantee track.
